Murder case to be tried again as a result of juror's misconduct

When you're accused of murder or another violent crime, it's important to know your rights and to take steps to protect yourself. Unfortunately, defending yourself might not lead to the outcome you hope for.

Take, for example, a case from 2015. A jury convicted a doctor in central New York of murdering his wife in their home. The day of the verdict, one of the alternate jurors reached out to the man's attorney. That juror discussed how another juror, one that had voted to convict the man, had exchanged over 7,000 messages with family and friends over the weekslong trial. This was a violation of the judge's requirement not to share or discuss information about the case until the trial was finished.

In October, the New York Court of Appeals agreed with the appeals court's decision from 2018 to set aside the previous ruling. After three years in prison, the doctor was released on bail.

A new trial is expected in the future, but this case points out the importance of each person's right to a fair and impartial trial.
