Deliveryman accused of stealing $90,000 worth of cakes

It is crazy how much can go on right under your nose.

A deliveryman in New York stole $90,000 worth of hand-made cakes over the course of four months beginning in November of 2018. David Lliviganay, who worked for Lady M Confections’ Long Island warehouse for two years, took 1,020 cakes from Big Apple Bakery. The highly-touted boutique sells the cakes for $90 apiece.

Lady M noticed that something was wrong when it learned that unauthorized dealers sold the high-end pastries at a significantly reduced price. This quickly led to an exhaustive investigation revealing the deliveryman as the culprit. Lady M is seeking the full value of the stolen goods plus interest in addition to punitive damages for his intentionally malicious behavior.

Cameras caught Lliviganay taking cakes from the warehouse freezer over 20 times. He reportedly brought large black bags into the warehouse, filled them up with the hand-made pastries and left undetected for four months. He proceeded to use a shipping cart to load the treats into his truck.

The police investigation into the matter led Lliviganay to take a vacation. His employer terminated his involvement with the company in March after he never returned to work. Lliviganay pleaded guilty to petit larceny and is currently awaiting sentencing.

Petit larceny is the lowest-level theft offense in New York. It is a Class A misdemeanor and carries a maximum sentence of one year in prison and a $1,000 fine. This charge is typically handed down to people who unlawfully take a property or service valued at no more than $1,000.

Based on the value of the amount of inventory stolen by Lliviganay, he could have faced charges of grand larceny in the second degree. This is a Class C felony offense carrying a potential sentence of up to 15 years in prison as well as a fine of $15,000.
