Man who served 30 years for rape is exonerated

| Dec 30, 2017 | Sex Crimes |

A now 47-year-old man who has spent 30 years in prison for a crime he didn’t commit has been exonerated. The New York City resident was identified decades ago in a lineup by a female who suffered a gang rape by three men at a Brooklyn, New York fast food restaurant where she was an employee closing up for the night. The three rapists said the accused was not even at the restaurant that night, but the victim’s testimony put the then 17-year-old behind bars.

An acting Brooklyn district attorney recently confirmed the man’s innocence and moved to dismiss his conviction. The man had always maintained his innocence and his family always stood by him. He was freed with the help of the Innocence Project — a group that works to overturn the convictions of those wrongfully incarcerated. The man would have had a lighter sentence had he admitted guilt, but he continued to maintain that he didn’t commit the crime.

At the time, the victim said there could have been a fourth attacker, but her eyes were covered during some of the attack. The trauma, however, could have distorted her memory. The man hasn’t said whether he will pursue compensation for his wrongful incarceration, but says he wishes he could have been the victim’s hero that night.

Those who are charged with a criminal offense like rape would do well to get the help of an experienced criminal defense New York attorney. A lawyer will aggressively defend the charges regarding his or her client. An attorney will also provide guidance to a client on what to expect in court and he or she will review all evidence in order to address legal and/or factual issues in court.
