SERVING NEW YORK WITH INTEGRITY & COMMITMENT

Three things to know about New York's strict gun laws

Although owning a gun is a right protected by the Constitution, various laws are present that regulate ownership. Gun owners should be aware of these laws, as violation can come with harsh penalties.

New York and guns: A state with a reputation for strict laws

New York is known for having some of the strictest gun laws in the country. These already stringent laws were expanded in 2013, following the Sandy Hook Elementary School shooting, with the New York Secure Ammunition and Firearms Enforcement Act of 2013 (SAFE Act).

Some areas of these laws that New Yorkers should be aware of include:

  • Magazines. It is wise to be careful the type of ammunition you purchase. New York state law bans the possession of high-capacity magazines.
  • Ammunition. In addition to purchasing the type of ammo carefully, it is also helpful to know that dealers of ammunition in the state are required to run a background check on customers before they can sell the ammo. This check is similar to the check run on customers wishing to purchase firearms.
  • Registry. The state also has an assault weapons registry. Anyone that owns a weapon that could be classified as an assault weapon is required to register the gun with the State Police.

These are just three of the more recent changes to gun laws in the state.

New York and guns: More changes may come

Recent gun violence has led lawmakers to consider passing laws that increase regulations around gun ownership. Although it is not yet known which of many proposals will pass, additional changes to gun law are likely.

Since this area of law is evolving, it is wise for those who face charges to take the charges seriously. Experienced legal counsel can craft a defense tailored for your case and work to better ensure that your rights are protected.
