SERVING NEW YORK WITH INTEGRITY & COMMITMENT

Man dies from heroin overdose, alleged drug dealer facing charges

Authorities in New Jersey and the attorney general's office in New York have been working closely together through the Northeast and Mid-Atlantic Heroin Task Force to arrest a 33-year-old man for the heroin overdose death of a 27-year-old man in New York. While lawmakers in New York are trying to pass a bill that would make "homicide by sale of an opiate controlled substance" a class A-1 felony in the state, New Jersey already has such a law. It's call the Strict Liability for Drug-Induced Death statute and it was passed back in 1987.

According to authorities, the 27-year-old man was found dead in his home in the middle of October. Next to his body, there were glassine envelopes and syringes. The envelopes had "Ball Room" stamped on them in black ink. When authorities looked at the man's phone, they found that he had contacted a man with the street name of "S." That man lived in Paterson, New Jersey, which is where the victim went and purchased heroin. Authorities in New Jersey knew the man who allegedly sold the victim the heroin.

A few weeks after the man died, "S" was arrested for allegedly selling 50 glassine envelopes with "Ball Room" stamped on them. He allegedly sold the heroin on the same block where the deceased man had purchased his heroin. The heroin was laced with fentanyl. The Drug Enforcement Administration notes that agents have seized more fentanyl in New York than last year -- 12 times more.

If you are facing drug charges, the penalties can be stiff. Should someone die of an overdose after using illegal drugs that you allegedly sold him or her, then you could be facing homicide charges. You will need an experienced criminal defense attorney to build a strong legal defense strategy to have a chance at mitigating the possible penalties.
