STREET CRIME DEFENSE WITH NO JUDGMENT

Pair of New Yorkers arrested on robbery charges

| Sep 25, 2013 | Theft & Property Crimes |

Two young adults from New York have been arrested on charges of attempted theft. The two men, aged 19 and 21, apparently stole a credit card and then tried to use that card to buy gift cards. The 19-year-old went into the store and approached a cashier to buy the gift cards. The cashier asked the man for some identification when he presented the stolen credit card. He ran and was caught; and soon thereafter, the 21-year-old — who was waiting in the car in the store’s parking lot — was caught too.

The two New Yorkers were arrested on a number of charges. Both were charged with conspiracy to commit theft. The 19-year-old was charged with attempted theft and providing false identification. The 21-year-old was charged with fleeing and reckless driving, in addition to running a red light. Both were held on significant bail amounts: $10,000 for the 19-year-old and $15,000 for the 21-year-old.

While these crimes certainly are serious, this story highlights some of issues of the criminal justice system. For example, though these two people are adults, they are still very young and prone to mistakes. They made a bad decision here; but should they pay with a permanent criminal record just for trying to get some gift cards? The list of charges is long, and seemingly duplicative: the 19-year-old has two different “theft” charges.

In any case though, people who are accused of robbery, burglary or theft need to consult an attorney to protect their rights during the criminal investigation process.
